FamilyZip Terms of Service This Terms of Service ("TOS") constitutes the entire agreement between yourself and FamilyZip.
Privacy Policy
FamilyZip was designed by parents who care about privacy. We DO NOT rent, sell, or share personal information. You can choose to share by inviting your friends to your network.
Anti SPAM Policy
We never send spam. Indeed, we hate spammers because they make it harder for legitimate companies to get their message through. We give you total control over what email you receive from us and at what frequency. When you sign up, we do send you occasional updates on Tips and your Friends, but you can change the frequency or unsubscribe at any time.
Prohibited User Conduct
FamilyZip is a family-focused network, so we have strict restrictions against obsene or offensive postings or behavior. All information whether publicly posted or privately transmitted ("Content") is the sole responsibility of the person authoring the content. Under no circumstances will FamilyZip be liable for any Content, including, but not limited to any errors or omissions.
You agree to NOT to:
- Impersonate any person or entity, including, misrepresent your affiliation with a person or entity; forge headers or otherwise manipulate identifiers including copyright management information in order to disguise the origin of any Content transmitted through the Service;
- Upload, post, email or otherwise transmit any Content that:
- is unlawful, harmful, threatening, abusive, obscene, or otherwise objectionable;
- infringes any trademark, trade secret, copyright or any intellectual property of any party;
- is unsolicited promotional material, "junk mail," "spam," "chain letters," "pyramid schemes," "multi-level marketing" or any other form of solicitation;
- contains software viruses or any other computer code, files or programs designed to interrupt or harm any software or hardware;
- Engage in activity on the website for the purpose of disrupting the website;
- Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
- Violate any applicable local, state, national or international law
FamilyZip has the right, but not obligation, to delete or move any Content. FamilyZip may preserve and disclose Content if required by law or in the good faith belief that it is necessary to: (a) enforce the TOS; (b) respond to claims that any Content violates the rights of third-parties; or (c) protect the rights, property, or personal safety of FamilyZip, its users or the public.
You understand the Content available on FamilyZip is transmitted over the public Internet and that FamilyZip does not assume control or responsibility over the public Internet or its security.
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITIES
THIS SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. FAMILYZIP EXPRESSLY DISCLAIMS ALL WARRANTIES EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. VERIFICATION OF ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS YOUR SOLE RESPONSIBILITY. FAMILYZIP SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, EVEN IF FAMILYZIP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Indemnification
You agree to indemnify and hold FamilyZip, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you post to or transmit through the Service, your use of the Service, your connection to the Service, your violation of the TOS or any laws, or your violation of any rights of another.
Intellectual Property Rights and Trademarks
When you post content to FamilyZip, you retain your rights to use your content as you see fit in any other venue or publication and you also grant FamilyZip an unlimited right to use and/or promote your content. If any of your posts are marked as problem posts, and you do not correct the problem within 45 days of them being marked as such, your post may be considered abandoned and reassigned to any other active member of the community. You agree not to copy, sell, resell or exploit for any commercial purposes, any use of or access to the FamilyZip Service or any derivative works based on the FamilyZip site - other than the content that you have specifically posted. The name FamilyZip and FamilyZip service mark are trademarks of Stacey Sao dba FamilyZip. You agree not to use any of the FamilyZip Marks without prior written permission.
No Automated Access or Data Mining
You may not send automated requests of any sort to FamilyZip's system without prior written permission from FamilyZip. This includes, but is not limited to: 1) using any software which sends requests to FamilyZip to determine meta-data on members or data, 2) automated searching FamilyZip, and 3) performing "offline" searches or accesses of FamilyZip.
